Nexstim Oyj including its affiliates (Nexstim, Inc. and Nexstim Germany GmbH, all together referred as “Nexstim”), is committed to respect your privacy and to comply with applicable data protection and privacy laws. This privacy policy (“Privacy Policy”) describes how we collect and use personal data collected on this website www.smartfocustmstherapy.com where Nexstim is the data controller or where we refer to the applicability of this Privacy Policy.

“Personal data” means information relating to you or another identifiable individual. By providing information to Nexstim and by using or accessing the Nexstim www -sites, any services or by participating to events offered by Nexstim, you acknowledge and consent to the collection, use and disclosure of personal data and other information as described in this Privacy Policy. If you do not agree with this Privacy Policy, please do not use this website.

What Information Do We Collect?

We collect your personal data and other information when you request services, use or register into our products and services, take part in campaigns or research or otherwise interact with us. This includes following categories:

When you request services or for example appointment with a clinic, participate in a research or campaigns or otherwise interact with us, we may ask for information such as your name, email address, phone number, street address, user names and passwords and feedback. We also maintain records of your consents, preferences and settings relating to, for example, location data, marketing and sharing of personal data.
  •  Use of products and services. When you access our services online, our web servers automatically create records of your visit. These records typically include IP-address, access times, the sites linked from, pages visited, the links and features used, the content viewed or requested, browser or application type, language and other such information. See also our Cookie policy below. Our applications may contact our servers periodically, for example to check for updates or to send us information relating to service usage. Additionally, we may invite you to join voluntary product and service improvement or research programs where detailed information is collected.   •  Positioning and Location data. Location-based services establish location through the use of satellite, mobile, Wi-Fi or other network based positioning methods. These technologies may involve exchanging your location data and unique device and mobile, Wi-Fi or other network related identifiers with Nexstim. We do not use this information to identify you personally without your consent.

When you use our location based services and features, for example location based search, navigation and routing, or request for map data, your location data is sent to Nexstim to serve you with the right content, which may also include location based advertising.

Minors

Nexstim’s policy is to request that “Minors” (the age of Minors is determined by local law where you reside) do not engage in legal acts on Nexstim www-sites without the consent of a parent or legal guardian, unless permitted by applicable local law.

Why Do We Process Personal Data?

Do We Share Personal Data?

  • Nexstim Group companies and authorized third parties such as our customer clinics using our TMS systems. We may share your personal data with other Nexstim group companies or authorized third parties, such as our customer clinics, who process personal data for Nexstim for the purposes described in this Privacy Policy. This may include for example, providing services including customer service.
  • Nexstim does not engage in the practice of selling or trading personal data to other companies for promotional purposes. Unless compelled by applicable law or administrative or judicial order, Nexstim will not provide personal data to a third party without your permission, except as necessary to fulfill your requests or manage interactive customer programs. If allowed by applicable local legislation, Nexstim may also exchange personal data between Nexstim’s affiliated (related) companies for the purposes mentioned in this Privacy Policy. Nexstim may also use subcontractors to provide some products or services to you. We also may need to share your personal data with these subcontractors so that they can provide services to us. Our subcontractors are not permitted to use such personal data for any other purposes and we impose confidentiality requirements on their services. In addition to aforesaid, Nexstim may provide aggregate statistics about our customers, sales, traffic patterns, training information and related site information to reputable third parties, but these statistics will not include personally identifiable information.
  •  International transfers of personal data. Our products and services may be provided using resources and servers located in various countries around the world. Therefore your personal data may be transferred across international borders outside the country where you use our services, including to countries outside the European Economic Area (EEA) that do not have laws providing specific protection for personal data or that have different legal rules on data protection, for example, the United States of America. In those cases Nexstim will take the needed action to ensure that adequate protection for your personal data as required by applicable laws.   •  Mandatory disclosures. We may be obligated by mandatory law to disclose your personal data to certain authorities or other third parties, for example, to law enforcement agencies in the countries where we or third parties acting on our behalf operate. We may also disclose and otherwise process your personal data in accordance with applicable law to defend Nexstim’s legitimate interests, for example, in civil or criminal legal proceedings.

How do we keep your data safe?

We have appropriate physical, technical and managerial controls in place to protect your personal details; for example our online forms are always encrypted and our network is protected and routinely monitored. Within our offices only those who have a business need to access your information and who are trained in handling data securely will have access to your information. We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. Whilst we hope it will never happen, we have procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are required to do so.

When we use external companies to collect or process personal data on our behalf we undertake due diligence on these companies before we work with them, and put a contract in place that sets out our expectations and requirements, including keeping and using your data securely.

Security

While there are always risks associated with providing personal data, whether in person, by phone or via the internet or other technologies, and no system of technology is completely safe or “tamper”/”hacker” proof, Nexstim has endeavoured to take reasonable precautions which are appropriate to prevent unauthorized access to and improper use of your personal data. For example, Nexstim uses encryption technology when collecting personal data. REQUEST CORRECTION OF YOUR PERSONAL DATA
You can request that we correct the personal data we hold about you. This enables you to have an incomplete or inaccurate data we hold about you corrected, although note that we may need to verify the accuracy of the new data you provide to us. Nexstim will at your request, free of charge, replenish, rectify or erase any incomplete, inaccurate or outdated personal data retained by Nexstim in connection with the operation of Nexstim Sites and other services. REQUEST DELETION OF YOUR PERSONAL DATA
You have the right to ask us to erase your personal data in certain circumstances.
